Maternity Allowance - Paternity allowance for the father

A father is entitled to replace his spouse during part of the maternity leave to care for the child, and to receive payment for the leave, if he and his spouse worked and accumulated an insurance period entitling them to a maternity allowance for 14 weeks, and the wife agrees to the father replacing her.

The father can replace the mother after she has been on maternity leave for at least 6 consecutive weeks after the birth and his leave will be at least 21 days.

In cases in which the mother, who is entitled to maternity allowance, is not capable of caring for the baby due to her health condition, the father can replace her at any stage of her maternity leave, after submitting a medical authorization, and on condition that he also meets the conditions of entitlement stipulated in the law.

The maternity allowance will be paid into the mother's bank account or into the couple's joint bank account.

Conditions for entitlement to a paternity allowance:

1.   The father is a salaried employee who has been given paternity leave by his employer, or he is self-employed and stopped working to take paternity leave;
2.   Insurance contributions were paid from his salary as a salaried employee, or he made insurance contributions from his income as a self-employed worker for 10 out of the 14 months or 15 out of the 22 months that preceded the "determining date for the father." 
The "determining date for the father" is the day he stops working due to the start of paternity leave, but not before 6 weeks have elapsed from the date of the birth.
3.   The couple is entitled to payment of the maternity allowance for 14 weeks.
4.   The new mother has declared in writing that she consents to waiving part of the maternity leave due to her, and she is returning to work during the period in which she waives the maternity leave.
5.   The father’s entitlement to the paternity leave will only commence after 6 weeks have elapsed since the birth.
6.   The father’s leave will not be less than 21 consecutive days.

A biological father who does not have a spouse may claim maternity allowance, on certain conditions. For further information, please contact the local NII branch closest to your place of residence.

Rates of the father's paternity allowance
The father’s paternity allowance is calculated according to his income in the three months that preceded the first of the month in which his “determining date” falls, but it will not exceed NIS 1,412.50 (as of 01.01.2012) per day. A father who receives a paternity allowance may be entitled to extension of the maternity leave and additional payment following a multiple birth or hospitalization of the baby.

Deductions from the paternity allowance
National Insurance contributions, health insurance and income tax are deducted from the paternity allowance at the rate prescribed by law.

Submitting a claim
1.   Fill out the Maternity Allowance Claim form and submit it to the National Insurance Institute branch closest to your place of residence.
2.   The form must be submitted within 12 months of the father's first date of entitlement.
3.   A salaried employee must ask his employer to fill out the required details on the claim form. A self-employed worker must enter on the form the date he stopped working and the National Insurance Institute branch at which he pays his insurance contributions.

Denial of entitlement
The National Insurance Institute may deny entitlement to a maternity allowance, in whole or in part, if, during the maternity leave, the applicant worked outside the home.
