Domestic Violence

 Under the Benefits (Child Orphaned due to Domestic Violence) Law-1995, a special benefit is paid to children whose parent was killed by a spouse. Such orphans receive this benefit in addition to the other benefits to which they are entitled, such as child allowance and survivors' pension.

Conditions of entitlement
A child who meets the following conditions is entitled to the benefit:
      • The murdered parent was an Israeli resident.
      • The parent was murdered by his/her spouse (including a common-law spouse), as determined by the State Attorney.
      • The murder occurred after March 1, 1994.
Eligible children
A child, including an adopted child or step-child, is eligible for benefit is he is one of the following:
      • He has not yet reached the age of 18.
      • He has not yet reached the age of 20, if he is studying in high school, or in a pre-military framework of the IDF.
      • He has not yet reached the age of 21, if he is volunteering in a military or national service.
      • He has not reached the age of 24, if he is serving in compulsory army service in the IDF, or in national service, or in an "Atuda" (pre-military studies) framework.
How to submit a claim for benefit
In order to receive the benefit for a child (who is a minor), the child's guardian, or the person recommended by the welfare bureau to care for his matters, should submit a claim for benefit under the Benefits Law to the Work Injury Department of any local NII branch.

 A child aged 18 or over should submit the claim himself.  

Rates of Benefit
 The maximum benefit  is equivalent to 75% of the average wage on the day of the murder - NIS 6,464 (as of 01.01.2012) .

The exact amount of the benefit is determined according to the number of children in the family as follows:

      • One child – 60% of the maximum benefit.
      • Two children – 80% of the maximum benefit.
      • Three children – 90% of the maximum benefit.
      • Four or more children – 100% of the maximum benefit.
