Disability - Receiving a disability pension while working

You can work, earn and receive a disability pension if the National Insurance Institute believes that, due to your medical condition, you are unable to earn more than you are actually earning, and if your gross monthly income from employment is one of the following:

1.   Your gross monthly income from employment is up to 25% of  average wage - NIS 2,155 (as of 01.01.2012) .
2.   Your monthly income from employment was reduced and it is half or less than half of the income you had from employment before the degree of your disability was established. In such cases, the entitlement is usually to a partial pension.

How does the NII determine whether your income from employment was reduced by at least half?

This is determined by comparing your gross monthly income from employment after establishment of your degree of disability to your income before establishment of your degree of disability (the income also includes one-time payments, such as clothing allowance, vacation pay, etc. calculated on a monthly basis).

Income before establishment of a degree of disability is calculated as follows:

         If you were a salaried employee - by your average income for 6 out of the 18 months that preceded establishment of your degree of disability (the six months with the highest income are utilized in the calculation).

        If you were self-employed - by your income for one of the 3 years that preceded the year in which your degree of disability was established (the year in which your income was the highest is the one that is utilized).

3.   If you did not work before the degree of your disability was established, or your income from employment (as a salaried employee or as self-employed) was low, the level of income from employment that enables you to continue to receive a disability pension is determined by your level of education, as follows:

        For academics or those with comparable education - up to 55% of the average salary in the economy (the average salary is NIS 8,619 (as of 01.01.2012) ).
        For high school graduates or those with comparable education - up to 45% of the average salary in the economy (the average salary is NIS 8,619 (as of 01.01.2012) ).
         For those with less education than the above, including those with no education - up to 37.5% of the average salary in the economy (the average salary is {10103).

For the calculation by education of 45% or 55% of the average salary, you must provide certification of your education. In such cases, the entitlement is usually to a partial pension.

If, after you find suitable work, you would like to know how what is the maximum income from employment that permits you to continue to receive a disability pension, please contact the claims officer to obtain more information and guidelines on the salary documentation that you must provide.

If your medical or occupational condition worsens in the future (termination of your job or reduction of your work / salary), you can contact the claims officer immediately and request a re-examination.

You must always notify the NII if you begin to work or if a change occurs in the scope of your work or your salary. From time to time, the National Insurance Institute checks ability to work and entitlement to a pension.
