Re-evaluation of the degree of disability due to worsening of the medical condition
A worked disabled person with a permanent degree of disability whose condition has worsened is entitled to request a re-evaluation of the degree of his disability, provided that 6 months have elapsed since the degree of his disability was last established (with the consent of a doctor authorized by the National Insurance Institute, the re-establishment of the degree of disability can be discussed before the end of the 6 months), and he has medical certification that his condition has worsened and that it is the result of the work injury for which the degree of disability was established. Only certification by a doctor authorized for that purpose by a health fund will be accepted.
A doctor authorized by the National Insurance Institute is also entitled to request a re-examination of a work disabled person with a permanent degree of disability, if 6 months have elapsed since the degree of his disability was last established. If the disabled person does not report for the re-examination without a satisfactory reason, the National Insurance Institute is entitled to terminate payment of his disability pension until he reports for the examination.
Re-evaluation due to a significant decrease in income
A work disabled person with at least a 20% permanent disability is entitled to request an increase in the degree of his disability if, due to the work injury, he suffered a significant decrease in income. The application must be submitted after 12 months have elapsed since the degree of his disability was last established, but no more than 60 months from that time.
