| Maintenance (Alimony) - Maximum period of entitlement |
Maintenance payments are made to a woman as of the date on which she submits an application to the National Insurance Institute. Payment for the period that preceded submission of the application will only be made after a clarification is conducted by the claims officer and subject to the conditions of entitlement.
The maintenance payments will be made as long as no subsequent court judgment for maintenance is issued that nullifies or changes the content of the preceding judgment, and as long as the other conditions of entitlement continue to exist.
Payments will be made for each child included in the court judgment until he reaches the age of 18.
With regard to a judgment that specifies one amount for all the children - when each one of the children reaches the age of 18, his proportional amount will be deducted from the amount specified in the court judgment (when the youngest of the children reaches the age of 18, the maintenance payments will cease).
With regard to a judgment that specifies one amount for the wife and the children - The payments will be paid in full until the oldest child reaches the age of 18, at which time his proportional part of the amount specified by the court judgment will be deducted. If the wife divorces, her proportional part in the amount specified by the court judgment will be deducted (when the youngest of the children reaches the age of 18, the maintenance payments will cease).
