Disability - Conditions of entitlement

1. disabled or a disabled housewife.
2. A person with a medical disability - A person for whom a National Insurance Institute doctor determined at least a 60% medical disability, or at least 40% in cases in which a medical disability of at least 25% was determined for one of the impairments.
A disabled housewife - A woman for whom a National Insurance Institute doctor determined at least a 50% medical disability.
3.  Degree of incapacity - The National Insurance Institute claims officer determined that the insured lost at least 50% of their capacity to earn or to function in the household.

“Disabled person” - A resident of Israel who is not a disabled housewife, who is at least 18 years old but has not yet reached retirement age and who, due to a physical, mental or emotional impairment, either congenital or resulting from an accident:

       He is not capable of earning a living from work or occupation, or his capacity to earn a living has been reduced as a result of his impediment (all at once or gradually) by 50% or more.
   He has no actual income from work or occupation.
       His income from work or occupation is no more than 60% of the average wage (that is, no more than NIS 5,171 (as of 01.01.2012) )  – for persons who are entitled to pension for a long period and who have a severe impediment (belonging to Group A). 
      His income from work or occupation is no more than 45% of the average wage (that is, no more than NIS 3,879 (as of 01.01.2012) )  – for persons who are not entitled to pension for a long period and who do not have a severe impediment (belonging to Group B).

Persons who meet one of the following conditions belong to Group A:
  A medical disability degree of at least 70% (weighted) has been determined for them.
  A medical disability degree of at least 40% (weighted) has been determined for them under Article 33 and/or Article 91 of the List of Impediments.
  They were entitled to a disability pension for at least 60 months out of the 80 months that preceded the coming into effect of the amendment (that is, in the period between August 1, 2002 and July 31, 2009).

Persons who meet all of the following conditions belong to Group B:
  A medical disability degree of between 40% and 69% (weighted) has been determined for them.
  A medical disability degree of at least 40% (weighted) has not been determined for them under Article 33 and/or Article 91 of the List of Impediments.
  They were not entitled to a disability pension for at least 60 months out of the 80 months that preceded the coming into effect of the amendment (that is, in the period between August 1, 2002 and July 31, 2009).

A housewife is also considered “disabled” if she worked as a salaried employee or as self-employed for 12 consecutive months or 24 non-consecutive months within the 48 months that preceded submission of her claim for a disability pension or termination of her work, for those who stopped working after submission of the claim, and if she is living apart from her spouse and had not lived with him for the 24 months before or after submission of her claim for a disability pension.

A “working minor” is also considered “disabled” from right before he sustained the incapacity.

“Disabled housewife” - A resident of Israel who is at least 18 years old but has not yet reached retirement age, is married and only works in her own household, and her husband is covered by National Insurance, old age and survivors insurance and, due to a physical, mental or emotional impairment, either congenital or resulting from an accident (unless she worked as a salaried employee or as self-employed):

         Does not have the capacity to perform the tasks that are customarily performed in regular housekeeping.

Or

         Her capacity to perform housekeeping tasks was reduced because of the impairment (whether at one time or gradually) by 50% or more.
