Appealling against a decision



If you disagree with the level of entitlement you were granted, or if your claim for long-term care benefit has been denied, you can appeal against the decision.

The appeal must be submitted to the Advisory Commission or a Regional Labor Court.

Please note, an appeal may lead either to the increase or confirmation without change of your level of entitlement, baring, in any case the reduction of your entitlement live.

Appeal before the Advisory Commission

The Advisory Commission is composed of a physician and a nurse who are not employed by the National Insurance Institute.

You must submit the appeal to Advisory Commission to the local branch handling your claim, within 60 days since reception of ruling notification. In your appeal, you have to detail the motives of your appeal, mention if you are interested in hearings held in your presence (or the presence of someone representing you), or without you and based solely upon documents attached to the appeal.

Appeal before a Labor Court

You are entitled to approach the Tribunal of Labor, and file an appeal against the decision of the National Insurance Institute.
