Survivors' pension recipient entitled to an additional benefit (other than old age pension)


Listed below are the persons entitled to a survivors' pension together with an additional benefit according to National Insurance Institute law, other than old-age pension:

  • A person eligible for a survivors' pension and for another benefit pursuant to NII law, such as benefit related to victims of work accident, general disability pension or work disability pension, may not receive more than one benefit, and hence must choose between one of them.
  • A person eligible for a survivors' pension who became eligible for a disability pension and chose the latter - entitlement to survivors' pension can be renewed at retirement age or upon discontinuation of entitlement to the disability pension for a reason other than marriage.
    In presence of children, they will keep receiving survivors' pension even if their parent have opted for the disability pension. In any case, the larger allowance between two specific benefits will always be paid to children. 
  • A person eligible for a survivors' pension and for a permanent work disability pension, is entitled to choose between the survivors' and the work disability pension.
    - Whether he chose the work disability pension - survivors' pension will end, however, under the law, a work disability pension shall never be of a lower amount than the survivors' pension.
    - Whether he chose the survivors' pension - he will receive the survivors' pension due him. In specific cases, the work disability pension may be capitalized (option to receive an one-time cash payment). When a work disability ends due to capitalization, entitlement to survivors' pension resume.
  • A person entitled to both a survivors' pension and a benefit to dependents of a work injured person as a result of the same event - the option is between the survivors' pension and the benefit to dependents of a work injured person.
    - Whether she chose the benefit to dependents of a work injured person the choose  - in any case, this pension shall not be of a lower amount than the survivors' pension. When she will become eligible for an old-age pension - she will be entitled to receive the benefit to dependents on a work injured person + half of an old age pension; or a full old age pension + half a benefit to dependents on a work injured person.
    - Whether she chose the survivors' pension - this pension will be paid to her.
    Then, when she will become eligible for an old age pension - she will be entitled to a full old age pension + half a survivors' pension.
  • A person entitled to both a survivors' pension and a benefit to dependents not as results of the same event - the option is between the benefit to dependents and the survivors' pension. For a widow who has chosen the benefit to dependents on a work injured person, the amount of the benefit to dependents will, in any case, not be lower than the survivors' pension.
    Upon becoming eligible to an old age pension, she will be able to opt for: half a survivors' pension due her from her husband, and full old age pension; or a full benefit to dependents on work injured person and half an old age pension; or half a benefit to dependents on work injured person and a full old age pension.

A person entitled to a survivors' pension as well as to an other benefit, although not under NII law, as a result of the same event.

A person who, due to the same event, is entitled to a survivors' pension as well as to another benefit under laws partially listed hereunder, will have to choose one of the two benefits at his discretion.

  • Families of Fallen Soldiers Law (compensations and rehabilitation) of 5710 - 1950;
  • Police Law (disabled and killed) of 5715 - 1955;
  • Prisons Service Law (disabled and killed) of 5720 - 1960;
  • Benefits to Victims of Hostile Actions Law of 5730 - 1969.
